Old Town Building Permit Moratorium in Effect as of July 5, 2017


In response to concerns raised by residents living in Lafayette’s Old Town district regarding residential redevelopment and a desire to maintain the unique character of the Old Town Lafayette area, a study and multiple community workshops and were conducted to review the City’s land use and zoning codes in that area. The Planning Commission reviewed proposed changes brought about as a result of this input, and assembled a list of recommended zoning code changes for City Council’s consideration. It is anticipated that City Council will act upon these recommendations within 90 days.

In order to prevent permanent improvements that would be detrimental to any proposed changes being considered, City Council has enacted a 90-day moratorium on the acceptance, processing, and issuance of building permits in the Old Town Lafayette area. Request for Exception
City Council may grant a special exception to the moratorium if the following conditions are met;

  • The issuance of the building permit is necessary to prevent undue, substantial hardship for the applicant; and
  • The issuance of the building permit will not affect the public interest or the purpose and reasons for this moratorium; and
  • The issuance of the building permit will be in accordance with all of the ordinances and regulations of the City of Lafayette as if the moratorium were not in effect.

In order to request an exception, a written submission must be submitted indicating the exact nature of the project proposed and the circumstances of the undue, substantial hardship that the applicant will suffer if the special exception is not granted. Elevations of all sides of the new building or addition, and a site plan with dimensions are required to accompany submissions.

Within thirty 30 days the City Council shall hold a public hearing on the application for special exception. Notice shall be given at least 7 days in advance of the public hearing. The owner of the property, or agent, shall be notified by mail. Notice of such hearing shall be posted on the property and shall be published in a newspaper with general circulation within the City of Lafayette at least seven 7 days prior to the public hearing. If an exception request is submitted by 10:00am on July 10, City Council will review the submission at the July 18 meeting. If a request is submitted by 10:00am on July 24, City Council will review the submission at the August 1 meeting.
