1. If I already registered with Boulder County, do I have to fill out a Lafayette application?: Yes. The City of Lafayette is a home-rule municipality and has its own set of city ordinances (laws) and its' own application and review process.

2. How do I apply?: To apply, please complete this application. Please ensure your application is complete along with all supporting materials (tax returns, W2s, bank statements, etc.).

3. Where do I submit my application and materials?

4. Will you give me back my application materials?: No, please do not provide originals as they will not be returned.

5. How long will the review take?: The review can take up to two weeks or more, and applications are reviewed in the order received.

6. How will I know whether I am qualified?: Once reviewed, the City will send you a “qualification letter.” That letter will have to go with your offer to the listing agent.

7. Do I have to live/work in Lafayette to qualify?: No, preference benefits do not apply to this sale since it is a resale.

8. Where can I find the current income limits?: Income limits are set by the U.S. Department of Housing and Urban Development (HUD) and can be found on the Boulder Housings website.

9. Where can I find the Community Housing Guidelines?: Download the Community Housing Guidelines.

10. Will this home always have to be affordable and how much will the home go up in value?

Yes, the home is part of the City’s permanently affordable housing stock, so it will remain permanently affordable.

The home value will increase each year by the lesser of the Consumer Price Index for wage earners (CPI-W) or 3% per year, calculated as simple interest. For example, if you owned the home for 10 years and the home value increased by 3% per year, the value would be the home price you purchased it for plus 30% (3% x 10 years). Keep in mind, it may increase by less than 3% if the CPI is less than 3%.

11. Do I need to check the status of my application?: No, the city will contact you once your application has been reviewed.

12. What if my application is not complete?: You will receive a letter stating your application is incomplete and will not receive a qualification letter. You may re-apply at any time, but please make sure your application and supporting materials are complete.

13. What if I don't qualify?: You will receive a letter stating you did not qualify and why.

14. What if I qualify but my offer on the home was not accepted?: You will be placed on the City's list of qualified home buyers. Lafayette keeps affordable housing applications for six months, then you would need to reapply. If another home comes on the market during the six month period, you will be notified.

Animal Control

1. Does my dog have to be on leash when we go for a walk?: Yes; the City’s running at large prohibited ordinance (section 25-61, Running at Large Prohibited) mandates that animals (including cats) must be under physical control (leash or in a pet carrier) at all times when off of their owner’s property. The only area where dogs are allowed to be off-leash is at the City Dog Park. Electronic collars are not recognized as appropriate control measures.

2. Can my cat roam in the neighborhood?: No; cats, dogs and other pets are prohibited from running at large (sectcion 25-61, Running at Large Prohibited). Cats must be confined to the owner's property at all times or be under leash control.

3. My neighbor's dog barks constantly. What should I do?: The City does have a barking dog ordinance (25-62) prohibiting animal owners from allowing their animals to make unreasonable noise or to disturb the peace and quiet of others by barking, whining, howling, etc. We encourage neighbors to talk with dog owners directly to try to resolve these types of issues. If the problem persists, contact animal control for assistance.

4. Do I have to license my dog?: Yes, all dogs over 6 months of age must be licensed with the City. One year and three year licenses are available at the police department, Mountain Ridge Animal Hospital and Jasper Animal Hospital. A copy of the dog's rabies vaccination certificate must be provided. Licenses are valid for a calendar year (January-December). A three year license may only be obtained for a dog that received a three year rabies vaccination within 30 days of applying for the license.

5. I was bitten by an animal. Should I report the incident?: Yes, in the interest of public safety, please contact the police department, 303-441-4444.

6. My pet is lost. What should I do?: Contact the Humane Society of Boulder Valley, 303-442-4030, to place a lost animal report and contact Lafayette Police Department Animal Control to report your pet missing,

7. I found a stray or feral cat. What should I do?: The City will only assist cats that are sick or injured and need immediate medical care. Residents can take found cats the the Humane Society of Boulder Valley.

8. Does the City of Lafayette have a Pit Bull ban?: No, there are no breed specific limitations in Lafayette. The City, however, has a very strict vicious animal ordinance that applies to any animal that acts in an aggressive or threatening manner.

9. How many dogs and/or cats can I own as a Lafayette resident?: Lafayette residents are allowed to have up to 3 dogs and 3 cats per residence.

10. I have an unknown critter living in, under or around my house. Will the City remove the animal for me?: No, the City does not remove nuisance wildlife. Residents are encouraged to remove all pet food, bird seed and other attractants from the yard, secure trash cans to prevent animals from accessing them and remove unnecessary vegetation from the property in an effort to discourage wildlife from taking up residence. Otherwise, residents are encouraged to contact pest control or wildlife specialists for these types of problems. Two resources are the Greenwood Wildlife Rehabilitation Center, 303-823-8455 and the Colorado Division of Wildlife, 303-291-7227.

11. There is a skunk/raccoon in my window well. What should I do?: The City does not assist with skunk and raccoon problems. You may contact a pest control service for assistance or try providing a ramp made of a rough surface. You may need to staple, nail or duct tape a heavy piece of cloth so that the animal can get a good grip. Place the ramp at an angle so the animal can crawl out. Colorado Division of Wildlife

12. Can I trap nuisance wildlife on my property?: Contact the Colorado Division of Wildlife directly, 303-291-7227, for permission and specific information on the types of animals that can be trapped and relocated. Colorado Division of Wildlife

13. I found a dead, wild animal on my property. What do I do?: It is not uncommon to occasionally find dead wildlife on your property. Wildlife dies for a variety of reasons and 1 dead animal should not cause too much concern. If you find dead wildlife on your property double-bag the animal and place it in the trash. If you find multiple dead animals, over a short period of time (24-48 hours) contact the Boulder County Public Health Department at 303-441-1564. There is a possibility the health department may want to test one or more of the animals. If you find a dead bat, contact Boulder County Health at 303-441-1564 or the police department at 303-441-4444.

14. I found a bat in my house or around my property. Should I be concerned?: Bats live among us and provide a benefit to humans by eating large quantities of insects. Occasionally bats will get into houses or be found on the ground. It a bat is found in the house or near a household pet contact the Boulder County Health Department, 303-441-1564, or the police department, 303-441-4444. Depending on the circumstances the bat may need to be tested for disease.

15. I saw a coyote or fox in my neighborhood. Should I be concerned?: Both coyotes and foxes live in urban environments because they provide the animals with their essential needs; food, water, shelter and space. These animals are attracted to neighborhoods due to the availability of garbage, pet food and even pets, which coyotes and foxes see as prey. The following list illustrates some of the attractants that draw coyotes and foxes close to people. Remove these attractants to discourage coyotes and foxes from visiting your property:
-Outdoor pet food or water
-Birdseed or food sources that attract small mammals
-Accessible garbage or compost
-Fallen fruit or berries from trees or shrubs
-Shrubs, woodpiles, decks or any other structure that can provide cover or be used as a den
Seeing wildlife can be an enjoyable experience and should not necessarily be a cause for concern, but you should haze wildlife if it is frequenting your neighborhood by yelling and/or throwing rocks or sticks toward the animal. Keep dogs on leash, don't allow pets to roam (especially at night) and never feed coyotes or foxes. Report any unusual behavior to the Division of Wildlife, 303-291-7227.

16. I saw an injured wild animal. What should I do?: In most cases if the animal is still mobile and able to survive in the condition it is in the City will not take action. If the animal is gravely injured, a threat to public safety or easily captured the City may respond with appropriate action, i.e transfer to a certified wildlife rehabilitator or humanely euthanize.

17. I found a snake on my property. What should I do?: Occasionally you will find a snake on your property. The two most common types of snakes encountered in Lafayette are the Garter snake and the Bull snake; both species are non-venomous. Snakes are beneficial to humans because they eat rodents and insects. Occasionally Bull snakes are mistaken for rattlesnakes because they mimic rattlesnakes by beating their tails on the ground. Look carefully at the snake's tail. If it does not have a rattle, it is likely a Bull snake. If you find a snake, leave it alone, provide an escape route and it will likely go on its way.

18. I have a bee hive on my property. Will the City remove it for me?: No, the City does not provide this service. Contact Boulder County Beekeepers, 303-678-6238, for assistance.

19. What do I do with deceased wildlife found on private property?: It is not uncommon to occasionally find dead wildlife on your property. Wildlife dies for a variety of reasons and 1 dead animal should not cause too much concern. If you find dead wildlife on your property double-bag the animal and place it in the trash. If you find multiple dead animals over a short period of time (24-48 hours) contact the Boulder County Public Health Department at 303-441-1564. There is a possibility that the Health Department will want to test 1 or more of the animals. 1. Who can apply for a permit?: Property Owners or their authorized agents (such as an approved tenant or a contractor licensed with the City of Lafayette) may apply for a permit.

2. What projects require a permit?: Per IBC Code Sec. 105.2 Any owner or owner’s authorized agent who intends to construct, enlarge, alter, repair, move, demolish or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by this code or to cause any such work to be performed, shall first make application to the building official and obtain the required permit. This includes all new construction, all commercial construction i.e.: remodels, tenant improvements, all additions, or alterations in or to an existing building or structure, any changes to electrical, plumbing, mechanical.

3. Does a storage shed require a permit?: All storage sheds that are 120 square feet or larger and accessory structures for all other uses of any size, meeting specific criteria require a permit. Learn more about Storage Sheds and Accessory Structures. (PDF)

4. Can I do the work myself or do I have to hire a contractor?: Homeowners may perform any work within their own home as long as it is their primary residence, is not intended for sale, resale, or rental, and they are doing the work themselves. Any work not specifically being completed by a homeowner shall be completed by contractors that are licensed with the City of Lafayette. All commercial work must be completed by contractors that are licensed with the City of Lafayette.

5. When does a permit expire?: Per ICC Code that has been adopted by the City of Lafayette every permit issued shall become invalid unless the work authorized by such permit is commenced within 180 days, or if the work authorized by permit is suspended or abandoned for a period of 180 days after the time the work is commenced.

6. Can the owner change the contractor after the permit has been pulled?: Yes, the homeowner may change the contractor to another licensed contractor by notifying the building department by email to buildingpermits@lafayetteco.gov.

7. How are permit fees calculated?: Fees are based off the valuation of the project; some are calculated while others may be a fixed fee. You may find the Fee Schedule on the City of Lafayette’s website under Building Permits. Additionally, all permits are subject to City and County Use Tax. Use tax is calculated at 60% of the project valuation which is the total of all material and labor for all building (framing, insulation, interior and exterior wall and ceiling roof coverings, flooring, cabinets, etc.), electrical, mechanical, plumbing, fire sprinkler, and fire alarm activities needed to complete the project. City Use Tax is calculated at 3.87% and County Use Tax is calculated at 1.185%.

8. How do I apply for a permit?: Quick permits only can be submitted online at https://web.mygov.us/ with a MyGov account. For all others download and complete the building permit application from the City’s website and submit with all required documents for the project to buildingpermits@lafayetteco.gov

9. What happens if I do work without a permit?: If you do any work without first obtaining a permit you can be subject to a Stop Work Order, double permit fees, having to demolish the work that was done, and possibly voiding your homeowner’s insurance in the event of damage or injury from unpermitted work.

10. What projects require an inspection?: All permits will require minimum of 1 inspection. Additional inspections may be required depending on the type of project. The inspection page will list the necessary inspections for the type of permit you have.

11. How do I schedule an inspection?: Inspections can be scheduled over the phone at 303-604-3822 or online in your MyGov account.

12. What do I need to do to prepare for an inspection?: All inspections will occur between 9am and 4pm. There must be someone over the age of 18 at the project address to provide access. You will need the building inspection record card and all approved field plans on site at all times and available for the inspector. Please ensure that pets are kept inside on any inspections that require access to the back of the property.

13. What happens during the inspection?: The inspector will review the plans, if applicable; verify that all required codes are met and either approve the inspection or provide a written list of code violations which will need to be corrected. Once all corrections have been completed, the inspection can be rescheduled. The inspector will sign the front of the permit record card when the inspection has been approved. 14. How do I cancel my inspection?: Please call 303-661-1451 the morning of your inspection between 8:00-9:00am, or you may email buildingpermits@lafayetteco.gov to cancel.

1. What is urban renewal?: Urban renewal is a tool used by local governments across the country to address the deterioration and conditions of blight within urban areas. Urban renewal can be used for development and rehabilitation when blighted conditions act as a barrier. It is a method for restoring economic vitality and improving the health and safety of urban areas.

2. What is Tax Increment Financing?: Tax Increment Financing is a public financing tool used to subsidize municipal economic development projects. When a TIF district is established, the amount of property and sales tax generated is set as the district’s base amount. As redevelopment takes place, any tax collected above the base amount is reinvested into the area to fund urban renewal projects and improvements.

3. Why is urban renewal important?: LURA’s involvement is essential because projects have unique challenges when blighted conditions are present. Contamination can burden previously developed sites through years of neglect, requiring significant work to restore their potential. Without urban renewal, it would be harder for property owners to tackle the challenges associated with redevelopment or rehabilitation.

4. Does the city offer economic development incentives for new retail projects or businesses that provide primary jobs?: The city does not have a specific economic development incentive program. Rather, we tailor our economic development incentives based on individual circumstances and individual projects. Depending upon the proposed location for the project, the proposed building architecture, financial gap, etc., the city has in the past waived building permit fees, provided sales tax rebates, and offered other economic development incentives. All projects seeking economic development incentives are reviewed by the city’s Economic Development Team.

Purchasing or selling a home

If you are purchasing or selling a home that receives utility services through the City of Lafayette, the title company will contact us to transfer services from the seller to the buyer. You may call us at 303-665-5588 to confirm that the title company has completed the transfer and to verify the services included on your City of Lafayette utility bill.

Title companies may request a final and request transfer by completing the Title Company Final Request Form (PDF).
- Email a copy of this form after all fields are completed. We may contact you if we have additional questions regarding the transfer. If you are having difficulty submitting your form, please contact utilitybill@lafayetteco.gov.
- If the closing date changes, notify us immediately by email, and then resubmit the Title Company Final Request Form with the correct information.
- If there is a post-occupancy agreement, please include this information in the email you send us with the completed form.

3. What is the City’s policy for late fees/disconnection?

Door Hangers will be issued at 8 am on Tuesday following Late Notices. This is to inform residents that they have TWO business days from the date the Door Hanger was issued to pay the past-due balance, including the late and door hanger fees. Otherwise, the service will be disconnected. If you are requiring additional time, we offer payment arrangements. Please call 303-665-5588 option 1 to discuss options, or email us at utilitybill@lafayetteco.gov. Payment arrangement requests must be made before 5 pm before the disconnection of services is to occur.

Disconnection of Services

To have services reconnected, the full balance due on the account must be paid with either cash, money order, cashier's check, or credit card. Checks will not be accepted. We are unable to enter into a payment arrangement once the services have been disconnected. If you make a payment online at www.lafayetteco.gov, you must call the Finance department at 303-665-5588 option 1. If payment is made after business hours, services will remain off until the following business day.

4. Can I set up a Payment Arrangement?

All Payment Arrangements must be requested via email to our Utility Billing Coordinator at utilitybill@lafayetteco.gov.

A Payment Arrangement can be made for an account if the account is more than 30 days past due.
An arrangement will not exclude the account from being assessed the $10 late fee.
Three payment arrangements are allowed per year and will be due up to two weeks after the arrangement is made.
If a payment arrangement or any part of a payment arrangement fails, no further arrangements will be allowed for the calendar year.
Arrangements are always due on Wednesday and must be for the full amount due on the account at that time. If a new bill has been generated that is not due yet, that is not included in the full balance due.
If payment in full is not received by 5 pm on Wednesday the arrangement is due, service will be disconnected at 8 am the following morning with no further notice.
A shut-off/turn-on fee will be assessed in the amount of $35 for customers inside city limits and $70 for customers outside city limits.
To have service reconnected, the Full Balance due on the account must be paid. Any balance incurred after the late notice was issued, except for the disconnection fees, does not need to be paid to have the service reconnected.
Checks will not be accepted for accounts that have been disconnected.
Payments can be made online at lafayetteco.gov or over the phone at 303-665-5588 option 1 using a debit or credit card. Residents can also come to City Hall Monday - Friday from 8 a.m. to 5 p.m. to make a payment with cash, money order, cashier's check, or with a debit or credit card.

2. Do you perform baby car seat checks?

Yes, please contact our office at 303-665-9661 or email rebecca.west@lafayetteco.gov to schedule. We have a nationally certified Child Passenger Safety Technician that can help.

3. My smoke or CO detector is beeping, but nothing is wrong. Why is it beeping?: Detectors often beep because the batteries are low or the detector is faulty. Try changing the batteries. If that doesn’t work you may need to replace the detector. Detectors should be changed every 10 years and the batteries should be changed every six months.

4. Are fire pits or chimeneas allowed?: Recreational fire pits or chimeneas are allowed if they meet the following criteria. Fire pits can be no larger than 3 feet in diameter and must be at least 20 feet away from any combustible material. Chimeneas must also be 20 feet away from any combustible material. Burning of yard waste or trash in the pit or chimeneas is strictly prohibited.

1. Should you fight the fire?

Fight the fire only if:

Everyone is evacuated from the building and the fire department has been called.
The fire is confined and not spreading.
You have an escape route that is not blocked by fire.
The extinguisher is the right type for the fire.
You know how to use the extinguisher.

If you can not put it out, leave immediately and close off the area. Make sure the Fire Department inspects the fire site, even if you believe it is out.

1. What can I donate?

The Friends apppreciate your donations of new and gently used items! We can accept a maximum of two boxes, or four bags, of:

Hardback/paperback fiction and nonfiction
Children’s books

Games and jigsaw puzzles

In order to take advantage of our space and maximize our ability to support Library programs, we are not able to accept:

Books that are dirty, missing pages, have writing in them, or have torn dust jackets
Study guides, home school materials, or company-specific materials (example: HR guides)
Magazines, pamphlets, brochures, binders
Music CDs

2. What can I do with items you do not accept?: If you have items that do not meet our donation guidelines, including older, damaged, or hard-to-recycle items, you may contact the Broomfield Recycling Center at 303-404-2839, or CHARM Recycle in Boulder at 303-444-6634 for information about recycling options.

3. Are my book donations tax-deductible?: Yes! If you need a receipt for tax filing purposes, please ask someone at the checkout desk to provide one.

4. How do I donate books and other items?: Donations are accepted during regular Library hours. There is a limit of up to four bags or two boxes. Please review guidelines prior to bringing in your items.

Historic Lafayette

1. Are there restrictions related to demolishing a building or structure that is 50 years or older?: Yes, the Historic Preservation Board Review Team reviews all demo permits for structures 50 years old or older. If it is determined that the building may have historically significance, the permit is referred to the Historic Preservation Board for consideration of a stay of issuing the permit. The Historic Preservation Board may issue a stay up to 90 days. The stay may be appealed to the City Council.

2. If my house is designated as a local landmark, does that mean I have to make it look more historic?: No, you can maintain the current look of your house as long as you would like. The Historic Preservation Board reviews only proposed changes to exterior architectural features. Routine maintenance of your house is exempt from review.

3. What is the definition of a demolition?

Demolition or demolish means an act or process that removes one (1) or more of the following: (Click on the municipal code link below for illustrated examples)

(1) Fifty (50) percent of the roof area, as measured in plan view;
(2) Fifty (50) percent or more of the exterior walls of a building as measured contiguously around the building envelop; or
(3) Any portion of an exterior wall facing a public street, but not an alley.

In order for a wall not to be considered a demolished wall, the wall shall meet the following minimum standards:

A. The wall shall retain studs or other structural elements, the exterior wall finish and fully framed and sheathed roof above that portion of remaining building to which such wall is attached;
B. The wall shall not be covered or otherwise concealed by a wall that is proposed to be placed in front of the retained wall; and
Each part of the retained exterior walls shall be connected contiguously and without interruption to every other part of the retained exterior walls.

Work on an affected structure may not be divided into two (2) or more separate projects for the purpose of evading or attempting to evade the requirements of this definition. Any two (2) or more projects on an affected structure, undertaken within any twenty-four-consecutive month period shall be treated as a single project for the purpose of determining whether a project constitutes a demolition.

6. What happens after I apply for a position?

We evaluate your application to determine whether you qualify for the position, by comparing your skill set, experience and education to the minimum job qualifications and requirements. We then screen the applications and determine the relevancy of your experience to the functions of the open position. The hiring supervisor further narrows the selection using an equitable method. Please note that meeting the minimum requirements of the position does not guarantee an interview. The hiring process might differ according to which position you have applied for.

The next step in the process usually is an interview; it might be a video one or in-person it depends. We sometimes screen a large applicant pool by conducting a meet and greet style interview. The meet and greet interview lasts about 15 minutes; 5 or 6 questions are asked. The next step is an in-depth interview with a board consisting of the hiring supervisor, the department director, a member of the Human Resources team, and a co-worker, using a prepared list of questions.

2. How do I stream free video?

The only streaming video currently available to Lafayette Library members is via Overdrive. The app for mobile devices or personal computers will allow limited offline use of downloaded video content. If you do not have Overdrive downloaded, you can stream (but not download) video directly from the Front Range Downloadable Library site.

The other app made by Overdrive, called Libby, does not provide access to streaming video, just ebooks and audiobooks.

Get started: Go to the Front Range Downloadable Library, click on the Collections menu, and you will see a section for Videos. You do not need to set up an Overdrive account, but you will need to log in using your Lafayette Library card number.

3. How does borrowing work for downloads?: Anything you borrow is available for 21-day checkout, and the download will stop playing after your date. You may also return finished items early. You can borrow six items at a time, and place up to five holds. Holds can be modified to be delivered as soon as they are available, or you can freeze your hold for later delivery. Oil and Gas Issues

1. Do companies have a right to drill within the City?: Yes. The owner of mineral rights located in the City of Lafayette has a right to extract such
minerals.

2. Are oil and gas companies allowed to use Lafayette water?: As a matter of policy, the City will not allow oil and gas companies to purchase Lafayette municipal water for their operations.

3. How does approval for oil and gas activity occur?: In Lafayette, all zone districts require oil and gas drilling extraction to obtain an approved Special Use Review (SUR). Notice of a request for a SUR is mailed to landowners within 750' of the proposed drilling activity. Subject to compliance with the City's rules and regulations pertaining to oil and gas extraction, a SUR may be reviewed at the staff level, or be forwarded to the Planning Commission. Staff review and approval takes 15 days with a 14 day appeal period and Planning Commission SUR approval can take approximately 30 days.

4. What is the purpose of a Special Use Review?: The purpose of the Special Use Review is to ensure that oil and gas extraction complies with the City's regulations. It provides nearby landowners a chance to comment on the application, and gives the City the ability to require certain site improvements to mitigate some impacts such as landscaping, berming, dust control, etc. Lafayette Development Code Section 26-22.1-3(a) states "In accordance with the procedures defined in this Section 26-22-1, within all zone districts, the operator shall apply for and receive special use approval prior to installing or constructing any oil and gas operation, including but not limited to drilling, reactivating a plugged or abandoned well, performing the initial installation of accessory equipment or pumping systems, reentry for purposes of sidetracking, deepening, recompleting or reworking, or performing enhanced recovery operations (e.g., injection wells) or installing, constructing, relocating or altering any access to any oil and gas operation provided that a special use approval for relocating or altering any access is required only if such relocation or alteration involves a change in point or means of access."

5. What is hydraulic fracturing (or "fracking")?: Hydraulic fracturing is used after the drilled hole is completed. Hydraulic fracturing uses fluid and material to create or restore small fractures in a geological drill formation in order to stimulate production from new and existing oil and gas wells. Smaller particulates, typically sand, are forced at high pressure into the drill hole and the adjacent formation. These particles create paths ("fractures") that increase the rate at which oil and gas can be released or extracted from the reservoir formations.

6. Are drilling and fracking the same thing?: While fracking often accompanies drilling in Colorado, it is not the same as the drilling process.

7. How can "fracking" affect ground water?: To ensure that neither the hydraulic fracturing fluid that is pumped through the well or the resulting oil or gas can enter the water supply, steel casings are inserted into the well to depths of between 1,000 and 4,000 feet. The space between these casings and the drilled hole is filled with cement. Once the cement has set, then the drilling continues from the bottom of cemented steel casing to the next depth. This process is repeated using small casings each time, until the oil and gas-bearing reservoir is reached, generally at a depth of 6,000 to 10,000 feet.

8. What chemicals are used in "fracking"?: The hydraulic fracturing consists mostly of water and sand, which make up 98 to 99.5 percent of the fluid. In addition, chemical additives are used. The exact formulation varies depending on the well. A typical fracture treatment will use very low concentrations of between 3 and 12 additive chemicals, depending on the characteristics of the water and the shale formation being fractured. Each component serves a specific purpose. For example, the addition of friction reducers allows the fracturing fluids and sand, or other solid materials called "proppants," to be pumped to the target zone at a higher rate and reduced pressue than if water alone were used. In addition to friction reducers, other additives include biocides to prevent microorganism growth and to reduce biofouling of the fractures, oxygen scavengers and other stabilizers to prevent corrosion of metal pipes, and acids that are used to remove drilling mud damage within the wellbore area. These fluids are used to create the fractures in the formation and to carry the propping agent (typically silica sand), which is deposited in the induced fractures to keep them from closing up.

9. Can the City force co-location of wells?: The City cannot force the co-location of wells nor prohibit the drilling of wells if the applicant meets all setback and separation requirements, and complies with all state and local rules and regulations.

10. What are the City's setback requirements for new wells?: Lafayette adheres to the State's setback requirement which is 500 feet.
Lafayette Development Code Section 26-22.1-4(1)(iii) states "Unless it would violate O.G.C.C. (a.k.a. C.O.G.C.C.) spacing rules, any wellbore, production tanks, on-site production equipment, shall be located not less than three hundred fifty (350) feet from a building, public road, aboveground utility line, railroad, wildlife habitat area, pedestrian, biking or horseback trail, features or sites with official designation as having important historic or archaeological value, building permitted for construction or a platted lot line for a lot which is covered by an approved preliminary plan for a residential or commercial use; or which preliminary plan is for an industrial use which industrial use is characterized by an extraordinary fire hazard concerns."

11. How many wells are within the City?: As of March 2017, there are 9 producing wells within the city limits. It is common for oil and gas wells to have a life of between 15-50 years, depending on a variety of factors. 12. Once a well is capped, can it be reentered?: Subject to COGCC approval, and obtaining Special Use Review approval from the City, a well can be reentered. However, to cap a well, a portion is filled with cement. Drilling through the cement may be more difficult than drilling a new well near the previously existing well site.

13. What is the surface owners' rights related to oil and gas extraction?: In general, unless otherwise agreed upon with the mineral owner, the surface owner's rights are limited. Surface owners cannot encroach on the mineral owner's activities or facilities, and may not interfere with the mineral owner's effort to produce the minerals. However, the mineral owner will typically negotiate a surface use agreement with the surface owner and can only enter the property for the purposes of installing, maintaining, and operating the facilities.

14. When purchasing property, are the mineral rights included?: Not always. The title commitment, which accompanies a transfer of property, will indicate an exception of mineral rights if they are not included. A mineral certificate can be purchased, which indicates who owns the mineral rights. It is best to consult an attorney for questions or for specific information.

15. Can an existing non-fracked well be fracked without additional approval?: Subject to the COGCC review process, and submit to a new SUR by the City, a non-fracked well could be fracked.

16. Can the City provide input for new wells proposed near the city limits?: The COGCC notifies the City's Local Government Designee (LGD) of any new permits applied for when the city limits are within the Section of a Township and Range of the proposed well. The Oil and Gas Guide for Local Governments, published by the Colorado Department of Local Affairs, outlines the LGD process. The COGCC is reconfiguring their systems to include a buffer around proposed wells in order to notify any jurisdictions within that buffer regardless of the Section of a Township and Range.

17. How are well locations determined?: The State of Colorado has defined drilling "windows" for each section of land (typically one square mile). Spacing rules for gas wells in each geologic formation vary. Wells drilled into other formations may be spaced at greater densities. Wells must be drilled within the window unless an exception is granted by the State. Wells may be drilled outside of the window for reasons such as avoiding flood plains, cliffs, or other terrain considerations.

18. Who, at the government level, is involved in approving oil and gas extraction?: The COGCC and the local municipality are the two entities involved in approving oil and gas extraction.

19. What rights does the City have regarding the regulation of oil and gas extraction within the City?: The City Attorney, in the memorandum dated July 12, 2012, outlined his opinions as to the City's ability to regulate oil and gas development activities. The City Attorney stated "Lafayette may regulate the impacts of oil and gas operations but only so long as those regulations do not impinge on operational aspects that are regulated by the state."

20. What would a moratorium prevent and what would it allow?: Depending upon the exact wording of the moratorium, it could prohibit the City from accepting an SUR application for a new oil or gas operation or a modification to an existing operation, and it could prohibit the City from processing any SUR applications that were submitted, but not approved, prior to the effective date of the moratorium. A moratorium would not prohibit the continued operation of an existing oil and gas well.

21. It appears the chemicals used in fracking have changed over the years. Why has this occurred?: The technological advances in fracking over the past fifteen to twenty years have increased the ability for mineral owners to extract greater amounts of oil and gas. In addition, the linear footage of vertical bored wells requires fewer fluids, including water and chemicals, than the linear footage of a directional bored well.

22. Do air, noise and visual mitigation requirements apply?: State regulations exist regarding noise, air quality, and visual impacts. Air quality and emission standards, in particular, are only monitored and governed by the State. Most aspects of potential surface impacts are part of local government regulations.

23. Has there been a study on how trucks will impact public roads? Who will pay for the repair work needed on these roads?: Staff has not conducted or commissioned a study on the impact of oil and gas extraction and ancillary activity to public roads. However, through the Special Use Review, the City could require oil and gas operator's to mitigate this impact.

24. How will the City regulate air pollution from the dust, vehicles, trucks, compressors, etc.? Who will monitor the pollution?: In general, air monitoring is conducted by the State. The City, however, requires compliance with the Municipal Code and the approved Special Use Review and could undertake enforcement actions, if necessary, for violations.

25. Is there a way to know which chemicals are used in fracking specific wells?: Colorado oil and gas developers have recently been encouraged by the COGCC to participate in a voluntary registry of specific chemicals that are utilized at specific wells, found at www.fracfocus.org. The COGCC website also contains various resources about the technique and the chemical content of fracking fluids.

1. Do I need to reserve a court to play pickleball?: There is currently no reservation system in place. The courts are open to the public on a first-come, first-served basis unless otherwise posted by the City. When full, courts are limited to one hour per team. The schedule for City-run programs and classes will be posted at the entrance.

2. When will the courts be finished?: While the courts are finished and open to the public, there are some surrounding elements pending installation.

3. Will there be lights in the courts?: There are no plans to add lights as the courts are located near residential areas.

4. Does the City clear the courts of snow? Can I bring a shovel?: The City does not clear the courts of snow or debris. Most shovels (especially metal shovels) can and will damage the courts' surface and void our warranty. You can bring a broom and water to clear the snow, but please refrain from using shovels.

5. Can we adjust the nets?: Please do not adjust the nets. When the nets were first installed, they needed to expand. The nets are now tightened to the proper height of 36 inches at the post and 34 inches in the middle. The City will adjust the nets as needed.

What is planned for the vacant property near my residence?: The City of Lafayette maintains two maps that guide and direct development: the Comprehensive Plan Land Use Plan Map and the Zoning District Map. The Land Use Plan Map designates the existing or potential future use of the property as residential, commercial, industrial, mixed-use, existing or proposed open space, floodplain, etc. The Zoning District Map includes zoning district designations for all property within the city limits and dictates allowable uses and certain building restrictions. By using these two maps one can determine what type of land uses are, or might be, allowed on property within the city limits, or on property outside of the city limits. 3. What should I do when I receive a public hearing notice?

2. Do I need to register my bicycle with the city?: Bicycle registration is not mandatory, but is encouraged, as it helps us to return your bicycle sooner, should it ever be stolen and recovered. It does not cost anything to register and can be done at the Lafayette Police Department during normal business hours.

3. How can I get speeders in my neighborhood to slow down?: The department has a radar activated "speed trailer," which can be set up in problem areas of your neighborhood. This device measures vehicle speeds and displays it to the driver along with the posted speed limit for that area. Studies have shown that it is effective in reducing the amount of speed violators. Extra patrols can also be scheduled in which available officers will be present to monitor speeds personally and address them with either tickets or warnings as needed. Together, they should effectively reduce the problem.

4. I purchased a pellet/BB gun in Lafayette, can I use it in Lafayette?: Although it is legal to purchase such items in the city of Lafayette, it is illegal to fire one ANYWHERE in the city, including private property.

6. Can I get legal advice from the police department?: No. By law, we are prohibited from giving legal advice.

1. How is the City of Lafayette’s drinking water treated?: All of the City’s drinking water is treated at the Baseline Water Treatment Facility on Baseline Road. The facility uses conventional treatment processes to produce water that meets state and federal requirements. The main treatment process steps include addition of coagulants that help remove small particles through gravity settling, filtration, and chlorine disinfection. Additional processes such as the use of activated carbon to reduce taste/odor and pH adjustments to reduce pipe corrosion occur as needed. The City provides regular water quality monitoring to ensure effective treatment. Monitoring results are published annually as part of the Consumer Confidence Report, available online.

2. Why does my water taste/smell like chlorine?: The City is required to disinfect water before it leaves the treatment plant and maintain sufficient chlorine levels in pipes and tanks to prevent bacteria growth. Chlorine levels are monitored at multiple locations across the City to ensure that they stay between the minimum and maximum levels established by the State of Colorado and the EPA. The system is also regularly monitored for bacteria at multiple locations. The amount of chlorine remaining in the water when it reaches a home can vary depending on the how long water is in the system before it reaches the tap. Chlorine will dissipate if drinking water is left in an uncovered container in the refrigerator overnight.

3. Why does my water smell musty, fishy or earthy?

Prior to being treated, the City’s water flows through creeks and ditches and is stored in reservoirs. These features function as a home to fish, wildlife, and aquatic vegetation. As water levels and temperatures vary over the course of the year, those ecosystems change.

In the spring, reservoirs fill with cold mountain snowmelt that has minimal plant material, but may be high in minerals picked up as runoff flows rapidly through creeks and ditches. During the spring and fall, temperature changes can cause reservoirs to “turn over” with cooler water sinking to the bottom and warmer water rising to the top. During the warm summer months, algae blooms can develop and then die off. In the fall, vegetation in and around the reservoir may die off or go dormant. In the fall leaves enter the reservoir and begin to decompose. During late summer and into winter, reservoir levels are drawn down as customer demands exceed stream flows. Each of these seasonal changes has impacts on the characteristics of the water that is delivered to the City’s water treatment facility.

The water treatment process filters out harmful materials and includes a disinfection process to prevent bacteria and organic materials from growing once water leaves the plant. Activated carbon is also used to help reduce any residual taste and odor. Even with treatment, there are subtle changes in water chemistry that can be detected by the human palette. Some people may also notice the process adjustments that are made to address source water variations, such as slight variations in chlorine levels.

Storing drinking water in the refrigerator can help reduce the variability of taste and odors due to changes in the City’s source water. Colder water releases less water vapor in to the air which impacts perceptions of variation in smell and taste. Storing water in the refrigerator also allows residual chlorine to dissipate. Running water until it turns cold before filling a pitcher will help flush out building plumbing and bring in fresh water from the City system.

4. Why is my water rusty brown/orange?: If water is frequently rusty brown/orange that may be an indication of an issue with home plumbing or a hot water heater. Issues in the City’s pipe system such as broken pipes, construction activities, and fire hydrant use can produce temporary discoloration that can get into building fixtures. Removing faucet screens and running the water for several minutes until clear typically addresses this issue.

5. Why is my water white or cloudy?: White water is typically caused by small air bubbles, which will dissipate in a few minutes. If the white water is caused by flakes that don’t disappear, this may be caused by a deteriorating dip tube in a home’s hot water heater.

6. Why is there pink/black mildew in my shower/sink/toilet?: Mildew can form in sinks, showers, toilets, or areas with stagnant water. Clean fixtures regularly and fix leaks to reduce mildew and mold growth.

7. My water tastes different. Is there something wrong with the water system? Is the water safe to drink?: The City of Lafayette’s water comes from mountain snow melt delivered to the City through a variety of creeks and ditches stored in local reservoirs, and treated at the Baseline Water Treatment Plant. The characteristics of the water delivered to the treatment plant vary depending on the water source, temperature, mineral content, and algae/vegetation. Treatment processes are regularly adjusted to ensure that health and safety requirements are met, but some customers may notice taste differences just as you might when traveling to a different city.

8. Why don’t other communities have this problem?: Most Front Range communities rely on multiple water sources and do experience some level of variability in water taste and odor over the course of the year. Having multiple sources is important in ensuring reliable water supply in the event of a drought or natural disaster.

9. Why does it taste/smell bad only when I run the hot water?: Hot water releases water vapor that may make any taste or smell more evident. It is a good practice to use the cold water tap for drinking and heat it as needed. Hot water is more likely to contain metals or other materials dissolved in building plumbing and hot water heaters.

10. Should I buy a home water filter?: A variety of home filtration devices are available ranging from water pitchers to expensive whole house systems. Filter manufacturers generally provide data on their product removal rates for different types of contaminants. The City’s Consumer Confidence Report provides data on Lafayette’s water quality that may be useful in assessing the benefit of specific home systems.

11. What is the City doing to improve water taste and odor?: The City has a number of efforts underway to improve the quality and consistency of drinking water. A first step is to increase our communications around source water changes so that customers can be confident that water is safe to drink. Modifications to the water treatment process are currently underway that are anticipated to improve efficiency in addressing impacts of summer algae blooms and should be completed in the next few weeks. The City is participating in several regional water projects that will both increase overall reservoir capacity, but also provide water from high mountain storage that is less susceptible to seasonal variability. The City also anticipates the need to build a second water treatment facility in the near future to address capacity limitations. This will provide an opportunity to explore new treatment technology and increase operational flexibility.

12. I’m still concerned, will the City test my water?: Before contacting the City, we recommend that you allow water to run for at least several minutes. If an issue goes away once water in the building plumbing is flushed out and new water is coming from the City main, then it is generally an indication of a possible problem in the home. The City cannot assess or repair home plumbing. If an issue persists, please submit your Taste & Odor concern to the Public Works Department through the web form or by calling 303-661-1277 and a water treatment operator will help assess the problem.

1. About LURA: The Lafayette Urban Renewal Authority (LURA) is the lead public entity promoting Old Town Lafayette's revitalization. LURA works in partnership with the City of Lafayette, private property owners, and businesses to remove blight, rehabilitate existing structures, attract new mixed-use development, and improve streetscapes to create an inviting and vibrant downtown.

2. What is urban renewal?: Urban renewal is a tool used by local governments across the country to address the deterioration and conditions of blight within urban areas. Urban renewal can be used for development and rehabilitation when blighted conditions act as a barrier. It is a method for restoring economic vitality and improving the health and safety of urban areas.

3. What is "blight"?: Blight is a legal term used to determine whether a neighborhood or commercial area can qualify for redevelopment or rehabilitation through urban renewal. Not every home or building in an urban renewal area is considered blighted. Some areas that qualify for redevelopment may have well-maintained homes or businesses interspersed among deteriorating structures and other conditions of blight. It is important to remember that the term blight can often feel subjective or vague. Because of this, Colorado Urban Renewal Law defines "conditions of blight.” To learn more about what is considered blight, please refer to Urban Renewal Definitions C.R.S. 31-25-103

4. What is Tax Increment Financing?: Tax Increment Financing is a public financing tool used to subsidize municipal economic development projects, including removing blighted conditions, infrastructure, redevelopment, rehabilitation, and other community improvement projects. When a TIF district is established, the amount of property and sales tax generated is set as the district’s base amount. As redevelopment takes place, any tax collected above the base amount is reinvested into the area to fund urban renewal projects and improvements.

5. What is LURA's role in the community?: We work in partnership with the City of Lafayette, private property owners, and businesses to ensure all redevelopment or rehabilitation efforts continue to attract visitors, fuel economic vitality, and emphasize the uniqueness, diversity, and historical value of Lafayette. LURA is working to make Public and Baseline Roads and Simpson Street welcoming places for those within our community and from neighboring communities to spend their days and evenings.

6. Why is urban renewal important?: LURA’s involvement is important because projects have unique challenges when blighted conditions are present. Contamination can burden previously developed sites through years of neglect, requiring significant work to restore their potential. The tax increment financing available through urban renewal allows communities to invest in thoughtful projects by filling the investment “gap” where properties or buildings are hindered by blight. Without urban renewal, it would be harder for property owners to tackle the challenges associated with redevelopment or rehabilitation.

7. What financing is available through LURA?

LURA works with private property owners, businesses, tenants, and the City on development, redevelopment, and rehabilitation projects in the Urban Renewal District. As part of this work, LURA will enter into an economic development agreement to provide loans or grants with the "tax increment” to fund a portion of the investment. The tax revenue must be used on improvements that advance the urban renewal plan and provide public benefits, such as site clearance, streets, utilities, parks, the removal of hazardous materials, building improvements, or acquiring real property. Since each project is unique, LURA will evaluate projects on their consistency with the urban renewal plan and the potential revenue relative to the cost of improvements.

In 2022, LURA launched the Old Town Façade Improvement Program, which provides matching grants to business and property owners who wish to make exterior improvements to commercial and residential buildings within the Old Town Urban Renewal District. The LURA Old Town Facade Improvement Program enhances and preserves the unique character of Old Town Lafayette, improves the economic vitality and marketability of the downtown, and creates an inviting downtown environment that will encourage visitors to stay in Old Town for extended periods of time. 8. Does being in an urban renewal area affect my property tax or property value?: There is no additional assessment of properties within an urban renewal area and no increase in the mill levy with the formation of the district. The value of the property improved by new construction or rehabilitation rises. Properties that are not rehabilitated generally remain unaffected or experience an increase in value because of improvements to nearby properties or because public improvements have added a general benefit to the area. The development community often perceives properties located within an urban renewal area as valuable because of the availability of financial incentives which are not available outside the district.

9. Why would I, a property/business owner, want to be included in an urban renewal area? What will the urban renewal plan do for me?: Owners and businesses benefit from public and private commitments and investments through association and proximity. LURA provides financing for projects that further revitalize, create jobs, improve property values, generate new tax dollars, and ensure investment in public amenities such as infrastructure and public art.

10. Does LURA only work on redevelopment and demolition projects?: Urban renewal projects can include the redevelopment or demolition of an existing building but may also include the rehabilitation of existing structures. Rehabilitation of existing structures can assist with retaining and expanding small businesses and enhance the unique character of Old Town Lafayette.

11. How long does urban renewal last?: The Colorado Urban Renewal Law authorizes tax increment financing (TIF) for 25 years. The TIF revenue starts collecting for the defined area when the urban renewal plan is formally adopted. While the TIF will expire after 25 years, the Urban Renewal Authority may continue to use funds and remediate blight within the urban renewal area for as long as funds are available.

12. How can I get in contact?: LURA believes public input is vital to revitalizing Old Town Lafayette. The Authority looks forward to the public’s help, guidance, and assistance in determining the community’s vision within the district. Be sure to add this to your address book and/or change your spam filters to allow this email to get through.

6. What if my email address changes?

You can send the new address to utilitybill@lafayetteco.gov, or call us at 303-665-5588.

7. What if I need to add or remove a name from the utility account?: Please email us at utilitybill@lafayetteco.gov if a name will be removed or added to the utility account. Additional information may be requested.

8. What if my name has changed?: Please email us at utilitybill@lafayetteco.gov or call us at 303-665-5588 option 1 to update the name on your account. Additional information may be requested.

9. Why is my water bill so high?

If your water bill is unusually high, there are a number of causes to consider.

Have you been watering your grass or garden?
Has your faucet been dripping?
Has your toilet been running?
- Add dye or food coloring to the back of the toilet tank. After 30 minutes, check the water in the bowl to see if color has leaked into it. If so, your toilet fill valve is leaking.
Do you have a whole-house humidifier?
Do you have a swamp cooler?
Have you checked your refrigerator's ice maker?
Has your water heater had any water come out from the seams or pressure release valve?

The City of Lafayette is unable to locate or repair leaks to the home. Any leaks that occur from the meter pit to the house is the responsibility of the owner. Please reach out to a professional plumber if you require locating or repairing a leak.

10. Can I pay my bill with a credit card?: Yes. You may pay online at http://www.lafayetteco.gov/payonline, pay over the phone, or pay in person at the Finance counter at City Hall, 1290 S. Public Rd., Lafayette, CO 80026.

11. Can I set up auto-pay?: You can set up automatic withdrawal from your checking account. Download/Print Automatic Bill Payment Enrollment Form and return it by mail or in person to 1290 S. Public Rd., Lafayette, CO 80026. You may also use your bank or credit card's bill pay services. Follow their instructions, but be sure to include the account number from your bill so your payment will be credited properly.

12. Can I pay in person or by mail?

To pay by mail, send check (add account number to check notes), with the top portion of your paper bill to: 1290 S. Public Rd., Lafayette, CO 80026.

To pay in person, visit Finance counter at City Hall, 1290 S. Public Rd., or use the drop box outside the main doors.

13. What is the City's Late Notice, Door Hanger, and Disconnection Policy?

*If the Monday the late notice is to be issued is a holiday, the late notice will be issued the next day.

14. Can I set up a Payment Arrangement?

City of Lafayette Payment Arrangement Policy

All Payment Arrangements must be requested via email to our Utility Billing Coordinator at utilitybill@lafayetteco.gov.

A Payment Arrangement can be made for an account if the account is more than 30 days past due.
An arrangement will not exclude the account from being assessed the $10 late fee.
Three payment arrangements are allowed per year and will be due up to two weeks after the arrangement is made.
If a payment arrangement or any part of a payment arrangement fails, no further arrangements will be allowed for the calendar year.
Arrangements are always due on Wednesday and must be for the full amount due on the account at that time. If a new bill has been generated that is not due yet, that is not included in the full balance due.
If payment in full is not received by 5 pm on Wednesday the arrangement is due, service will be disconnected at 8 am the following morning with no further notice.
A shut-off/turn-on fee will be assessed in the amount of $35 for customers inside city limits and $70 for customers outside city limits.
To have service reconnected, the Full Balance due on the account must be paid. Any balance incurred after the late notice was issued, except for the disconnection fees, does not need to be paid to have the service reconnected.
Checks will not be accepted for accounts that have been disconnected.
Payments can be made online at lafayetteco.gov or over the phone at 303-665-5588 option 1 using a debit or credit card. Residents can also come to City Hall Monday - Friday from 8 a.m. to 5 p.m. to make a payment with cash, money order, cashier's check, or with a debit or credit card.
